Telegram Court Seeks CFTC Opinion on Tokens

The New York court in the Telegram ICO case appealed to the lawyers of the US Commodity Futures Trading Commission (CFTC) with a request to express their opinion on the messenger tokens.

For four months, the US Securities and Exchange Commission (SEC) has been trying to prove that the sale of the Gramm in 2018 was illegal because tokens are securities that have not been registered in a timely manner.

Telegram, in turn, insists that its tokens are not an investment tool, and after the launch of the TON blockchain, they will actually become a commodity, like bitcoin or ether, since their value will lie in the widespread use by users of the messenger.

Judge Kevin Kastel appears to have been convinced by the arguments of both parties and decided to contact the CFTC’s office of attorney for his views on the matter. Such a move could play into the hands of Telegram, since earlier the chairman of the US Commodity Futures Trading Commission, Heath Tarbert, said that cryptocurrencies fall under the jurisdiction of his department..

After the decision to request the opinion of the CFTC, the judge also postponed the date of the first hearing in the case to February 19..
